Liability Disclaimer, Waiver, and Rules of Use

NOTICE TO GUESTS: This is a legally binding document. Please read it carefully before signing. By signing this agreement, you are giving up certain legal rights, including the right to sue.

This document outlines the terms and conditions for the use of the Zen Garden and Hot Tub area (the "Amenities") at Above The Narrows Bed and Breakfast (the "B&B"), located in British Columbia, Canada.

1. Assumption of Risks

I/we, the undersigned guest(s), acknowledge that the use of the Amenities involves inherent risks, dangers, and hazards. I/we understand that these risks can lead to serious injury, including death, and/or property damage. These risks include, but are not limited to:

  • Slipping and falling on wet or uneven surfaces around the hot tub and decking area.
  • Drowning or near-drowning incidents.
  • Injuries resulting from falling from the decking area.
  • Injuries resulting from climbing on trees, railings, or other structures.
  • Health complications arising from hot tub use, such as overheating, fainting, dizziness, nausea, or skin, ear, and eye infections.
  • Aggravation of pre-existing medical conditions.
  • The transmission of communicable diseases.

I/we voluntarily and expressly agree to assume all risks associated with the use of the Amenities.

2. Rules and Regulations

To ensure the safety and enjoyment of all guests and to respect our neighbours, the following rules must be strictly followed at all times:

Hot Tub Rules

Age Restriction No person under the age of 19 is permitted in the hot tub at any time.
No Running or Jumping Do not run, jump, or dive into the hot tub. Enter and exit slowly and feet-first.
Time Limit Limit your time in the hot tub to a maximum of 15 minutes at a time to avoid overheating.
Temperature The hot tub temperature shall not exceed 40°C (104°F).
Health Advisory Pregnant women and individuals with health conditions such as heart disease, high blood pressure, diabetes, or other serious illnesses should consult a physician before using the hot tub.
Alcohol and Drugs Do not use the hot tub while under the influence of alcohol, cannabis, or any other substances that may cause drowsiness or impair judgment.
Hygiene Shower before entering the hot tub. Do not use the hot tub if you have open wounds, skin infections, or have experienced vomiting or diarrhea within the past 48 hours.

Zen Garden Rules

Respect the Garden Do not pick the flowers or disturb the rock arrangements.

Zen Garden and Decking Area Rules

No Climbing Do not climb on any trees, railings, fences, or other structures in the Zen Garden or decking area.
Fall Prevention Exercise caution at all times to prevent falls from the decking area. Do not place yourself in a position where you may be at risk of falling.
Walkways Walk, do not run, on all surfaces in the Zen Garden and decking area.

General Conduct Rules

Hours of Use Zen Garden and Hot Tub Hours are from 6:00 AM to 10:00 PM.
Noise Please keep noise to a minimum. Quiet hours are in effect at all times to respect our close-by neighbours.
Supervision All guests are responsible for their own safety and the safety of those in their party.
Respect for Property Please treat the Amenities with care and report any damage or safety concerns to the B&B management immediately.

3. Release and Waiver of Liability

In consideration for being permitted to use the Amenities, I/we hereby agree to release, waive, and forever discharge Above The Narrows Bed and Breakfast, its owners, operators, employees, and agents (collectively, the "Releasees") from any and all liability, claims, demands, actions, and causes of action whatsoever, arising out of or related to any loss, damage, or injury, including death, that may be sustained by me/us, or to any property belonging to me/us, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, while participating in, preparing for, or travelling to and from the Amenities.

I/we further agree to indemnify and hold harmless the Releasees from any loss, liability, damage, or costs, including court costs and legal fees, that they may incur due to my/our participation in the use of the Amenities, whether caused by my/our negligence or otherwise.

4. Acknowledgement of Understanding

By signing below, I/we acknowledge and agree to the following:

  1. I/we have read this entire document and fully understand its terms.
  2. I/we are aware that by signing this document, I/we are waiving substantial legal rights that I/we and/or our heirs, next of kin, executors, administrators, and assigns may have against the Releasees.
  3. I/we have had the opportunity to seek independent legal advice before signing this document.
  4. I/we sign this document voluntarily and without any inducement.
  5. I/we agree to abide by all rules and regulations set out in this document.

This agreement is governed by the laws of the Province of British Columbia.
